1. Introduction

Welcome to Ocean Odyssey. These Terms of Use govern your use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you may not use our Services.

Ocean Odyssey offers maritime adventures, sailing expeditions, and related services. These Terms of Use constitute a legally binding agreement between you and Ocean Odyssey regarding your use of our platform and services.

2. Account Registration and Security

To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account password and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

3. Booking and Payment Terms

When you book a voyage or maritime experience through our Services, you agree to pay all fees and charges associated with your booking. All bookings are subject to availability and confirmation. Prices are subject to change without notice until your booking is confirmed.

A non-refundable deposit of 25% of the total voyage cost is required to secure your reservation. The remaining balance is due 90 days prior to departure. For bookings made within 90 days of departure, full payment is required at the time of booking.

We accept major credit cards, bank transfers, and other payment methods as specified during the checkout process. All transactions are processed in US Dollars unless otherwise specified.

4. Cancellation and Refund Policy

Our cancellation and refund policy is as follows:

• Cancellations made 120 days or more before departure: Full refund minus the non-refundable deposit
• Cancellations made 90-119 days before departure: 75% refund minus the non-refundable deposit
• Cancellations made 60-89 days before departure: 50% refund minus the non-refundable deposit
• Cancellations made 30-59 days before departure: 25% refund minus the non-refundable deposit
• Cancellations made less than 30 days before departure: No refund

All cancellation requests must be submitted in writing to our customer service team. The date of receipt of your cancellation request will determine the applicable refund amount.

We strongly recommend purchasing travel insurance to protect your investment in case of unforeseen circumstances.

5. Health and Safety Requirements

Ocean voyages require a moderate level of physical fitness and mobility. By booking a voyage with us, you confirm that you and all members of your party are in good health and have no medical conditions that could be aggravated by the activities involved in our maritime experiences.

You must inform us at the time of booking of any existing medical conditions, disabilities, or special needs that might affect your ability to participate in the voyage. We will make reasonable efforts to accommodate special needs, but we cannot guarantee that all accommodations will be possible.

We reserve the right to refuse participation to anyone whose health or behavior could impede the operation of a voyage or negatively affect the experience of other participants.

6. Intellectual Property Rights

The content, organization, graphics, design, compilation, and other matters related to our Services are protected under applicable copyrights, trademarks, and other proprietary rights. Copying, redistribution, use, or publication by you of any such content or any part of our Services is prohibited without express written permission from Ocean Odyssey.

Ocean Odyssey and its logos are trademarks of Ocean Odyssey Maritime Adventures, Inc. You may not use our trademarks without our prior written consent.

7. User-Generated Content

Our Services may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. By providing such content, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through our Services.

You agree not to post content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Infringes on intellectual property rights of others
• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of our Services
• Constitutes unsolicited advertising or promotional materials

We reserve the right to remove any content that violates these Terms of Use or is otherwise objectionable in our sole discretion.

8. Limitation of Liability

To the maximum extent permitted by law, Ocean Odyssey, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of our Services.

Our total liability for all claims related to the Services shall not exceed the greater of $100 or the amount you paid to Ocean Odyssey in the past 12 months.

9. Force Majeure

Ocean Odyssey shall not be liable for any delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to acts of nature, weather conditions, government restrictions, pandemics, or other force majeure events.

In case of voyage cancellations due to force majeure events, we will offer rescheduling options or credit for future voyages. If a voyage is interrupted due to such events, we will make reasonable efforts to arrange alternative transportation or accommodations, but additional costs incurred may be your responsibility.

10. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Newport, Rhode Island for the resolution of any disputes.

11. Changes to Terms of Use

We reserve the right to modify these Terms of Use at any time. We will notify you of significant changes by posting a prominent notice on our Services or by sending you an email. Your continued use of our Services after such modifications will constitute your acceptance of the revised Terms of Use.
